About the Role
The Litigation and Servicing Paralegal is responsible for case management of loan files related to servicing litigation, including routine and contested foreclosure matters, bankruptcy filings, title matters, and mediation. As the Litigation Specialist, you will maintain a case for each matter, complete initial intake, document status of the litigated issue, assess risk, work closely with inside and outside counsel in an attempt to resolve each matter, and organize supplementing data and information to support servicing litigation.
What You’ll Do
- Serve as the primary contact for initial litigation inquiries concerning the servicing of HELOCs and other consumer lending products, ensuring efficient case intake and documentation
- Manage the transition of historical records into new internal system, prioritizing data integrity and ease of access
- Analyzing mortgage servicing documentation for potential legal issues, with a focus on title, AOM, foreclosure, and bankruptcy processes, and reporting identified issues, including root cause and resolution suggestions, to Legal/Compliance and the business
- Facilitate the smooth transfer of cases requiring more specialized handling to a special servicer or outside legal counsel by providing detailed case files and essential background information
- Serve as corporate witness and deliver testimony for hearings, trials, depositions as necessary; both in-person and telephonic meetings required
- Collaborate with internal stakeholders to determine the appropriate escalation of matters to the corporate litigation team, fraud prevention units, or other pertinent departments
- Compile, review and analyze Company records and organize them in response to subpoenas and discovery demands. Work closely with Product Counsel and Compliance when legal/mortgage research is necessary to support activities
- Develop case strategy in an attempt to resolve the matter as quickly and cost-efficiently as possible and negotiate settlement arrangements within delegation of authority
- Manage, monitor and track litigated files which include but are not limited to contested, title, mediated and bankruptcy proceedings
- Evaluate reports and research risk and potential risk of legal documentation
- Support in-house counsel, on research projects regarding servicing issues and pre-litigation customer disputes
- Perform other related duties as required and assigned
- Demonstrate behaviors which are aligned with the organization’s desired culture and values
- Make process improvement recommendations for Figure’s products and services.
- Provide on-site office coverage as needed to support the needs of the business
- Champion the achievement of corporate, divisional, and departmental goals by being accountable for team operations as it pertains to attendance, performance, production, and quality.
What We Look For
- 5-7 years Mortgage Servicing or Financial Service experience; must serve as Subject Matter Expert (SME) on all servicing related matters
- Experience accessing and researching Court websites and databases
- Bachelor’s degree and/or Paralegal Certificate preferred
- Knowledge of legal pleadings and ability to review and decipher allegations and issues
- Proficiency with the Google suite of software including Sheets, Slide, Docs, Slack, GMail, etc
- Ability to adapt to new technology and systems, familiarity with various mortgage servicing platforms
- Proficiency in reading legal documents and understanding required course of action and/or response. Ability to escalate when a knowledge gap is present
- Ability to assess risk and take appropriate action
- Ability to read title and identify issues
- Flexibility and adaptability to ongoing refinements in process and structure
- Confident, friendly, and assertive communication skills
- Ability to successfully complete the required compliance training
- Ability to travel up to 25% as required for in-person appearances or other corporate meetings
For CO, NY, CA and WA residents, the salary range for this position is $80,000 - $100,000/year with a 25% Bonus and Equity. Actual compensation may vary based on individual candidate experience and location.
